Trial for former Bozeman High School track coach rescheduled

A trial for the former Bozeman High School track coach accused of sending lewd text messages and photos to his female athletes has been rescheduled for this summer.

James Michael Evans, 30, was charged in 2010 with two counts of felony sexual abuse of children and three counts of misdemeanor obscenity after Bozeman police alleged he had been sending sexually explicit messages to two 15-year-old girls.

The obscenity charges have since been dropped; however, a felony charge for attempted tampering with evidence was later added.

Evans’ trial date has been set for July 23.

Evans appeared at a pretrial motions hearing in front of Gallatin County District Judge Mike Salvagni on Tuesday.

Evans’ attorney, Al Avignone, filed a flurry of motions for the case to be dismissed. The motions question the validity of evidence police gathered in the investigation. Avignone maintains that Evans was not read his Miranda rights prior to police asking him where his cellphone was after being arrested.
